Bankruptcy And The Economy
Falling Into A Hole
With the way the current economy is right now, more and more people are finding themselves in financial troubles. People are losing their homes to foreclosure, so they are forced to try to sell them. If you look at your local newspaper you will see that many people are selling their items to help pay for the rising cost of utilities. However, even this does not always help people out. Some are finding themselves falling into a hole with no way out and sometimes there only choice is to file bankruptcy. If you should happen to find yourself in this situation, then here is some advice for you to know.
Bankruptcy Attorney
First thing you need to do is to find a good bankruptcy attorney. Many out there do not charge for the first consultation. Make an appointment to meet with him/her; they will talk to you about the different options available to you. Make sure you choose an attorney that you feel comfortable with, and one that you feel communicates well with you. Remember when talking about bankruptcy, you are dealing with federal laws and federal court, so bankruptcy can become very confusing and scary.
Claimed Cost
Second, when choosing your attorney, most likely you will need to have most of the money for his/hers cost up front, if not all. Your attorney should explain to you that his/her cost cannot be claimed in your bankruptcy, so you want to be sure of your attorneys cost before hand and make sure that there will not be any other charges.
Listing All You’re Debts
Third and final tip make sure that you list all your debts, even if you are not sure you owe them any money. If there is a possibility that you might owe a creditor, then put their name on the list that you will be filling out. Something for you to also be aware of, even if you have credit cards that have a zero balance. Do not be surprised if the creditors cancel them on you. Some attorneys say that they probably will not, but this is not true. The sad thing is if they do cancel your accounts, they will not notify you at all. You will most likely find out when you go to use them, and of course, this can be quiet embarrassing. My suggestions to you is take time and notify them, tell them your situation and see if they are willing to keep your account open, and maybe just lower your credit limit. Do not be surprised though if they tell you no.
A final note bankruptcy is not easy and starting over is a long haul, but it can help you when you have gotten yourself to the point of no return.
The idea of being freed from debt can be appealing. Bankruptcy will provide you with legal protection from your creditors and take care of all or much of your debt. There is the chance you will get to keep your home and car. Bankruptcy will also stop wage garnishment, debt collection harassment and similar creditor actions to collect debts that you owe. It can also stop foreclosure on your house or mobile home, and help restore or prevent shut-off of utility service.
In other words, bankruptcy can “put the brakes on” if you are headed for financial ruin. By wiping out your old debts, you are likely to be in a better position to pay your current bills.
